The Building Regulations 2010
The Building (Local Authority Charges) Regulations 2010
In accordance with the Building (Local Authority Charges) Regulations 2010, the London Borough of Merton is
required to recover costs incurred in providing their function relating to the Building Regulations.
With effect from 1
st
July 2019 there are three scales of charges:-
1. For the erection of small domestic buildings not exceeding three stories including basements and
connected work, i.e. houses and flats with a floor area not exceeding 300 square metres;
2. For certain small buildings, i.e. detached garages and car ports not exceeding 40 square metres floor
area and not being exempt from Building Regulations, extensions, constructions of rooms in the roof
space, the installation of certain cavity fill insulation, the installation of some unventilated hot water
systems, some replacement window installations, installation of some heat producing appliances, and
some electrical installations and;
3. For all other material works.
Full Plans Submission
Plans that are deposited in accordance with Building Regulation 12 (2)(b) of the Building Regulations 2000 (as
amended) must be accompanied by the appropriate charge including VAT.
1. For small domestic buildings the plan charge (plus VAT) will be required in accordance with column 2 of
Table 1 which must be deposited with the plans. An inspection charge, (plus VAT), equal to the sum shown
in column 4 Table 1, must be paid on demand (by invoice) after the first inspection has been carried out by
the Building Control Surveyor.
2. For small buildings and extensions to dwellings including the construction of rooms in the existing loft
space the plan charge (plus VAT) will be required in accordance with column 3 of Table 2 which must be
deposited with the plans. The inspection charge (plus VAT) shown in column 6 must be paid on demand (by
invoice) after the first inspection has been carried out by the Building Control Surveyor.
3. For all other types of work an estimate which is a reasonable amount that would be charged (excluding
VAT) by a builder for carrying out that work, which is acceptable to the Council, must be deposited in writing
with the plans. Where this
estimate does
not exceed £5,000 the charge (plus VAT) is as indicated in Table 3
and must be deposited with the plans. No further charge will be rendered for those works.
Where the estimated cost of the works exceeds £5,000 then the plan charges (plus VAT) as indicated in Table 3
must be deposited with the estimate and plans. The inspection charge (plus VAT) as indicated in Table 3 must be
paid on demand (by invoice) after the first inspection has been made by the Building Control Surveyor.
NOTE
1. No additional plan charge will be required for plans deposited as a subsequent submission following the
rejection of plans for which a charge has already been paid or which relates to departures or deviations of
essentially the same project where deposited plans have already been passed by the Council.
2. No charge will be made where this Authority is satisfied that the works in question are solely for the
purpose of providing means of access for disabled persons to or within an existing building, or for providing
facilities designed to secure their greater health, safety, welfare or convenience and is carried out in
relation to an existing building to which members of the public are admitted or is an existing dwelling
occupied by a disabled person.
3. Should any cheque submitted with the plans be returned to the Council not honoured by a bank the
relevant plans shall be considered as though not submitted and work should not start.
4. Should plans be submitted without an accompanying estimate, as defined above, those plans will be
considered as not having been deposited, and work should not start.
5. Where plans are deposited without the deposit of the requisite charge those plans will be considered as not
submitted and work should not start.
